User Agreement

Limited License

FireDataOnline grants you nonexclusive, nontransferable, revocable limited license to access and use the FireDataOnline service in accordance with these terms and conditions of use.

Limitations on Use

You may not copy, modify, merge, decompile, reverse engineer, or disassemble any software or content provided as part of FireDataOnline. You may not rent, lease, loan, sell, sublicense, or create derivative works from any software or content provided as part of FireDataOnline. You may not use any network monitoring or discovery software to determine the site architecture of FireDataOnline.

Intellectual Property

Except as expressly provided in these terms and conditions of use, nothing contained herein shall be construed as conferring any license or right under patent, copyright, or trademark. You agree that FireDataOnline is protected by copyrights, trademarks, and/or patents.

License to Provider

You grant FireDataOnline a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, and/or cerate derivative works from any content that you upload to FireDataOnline. You further grant FireDataOnline a perpetual, royalty-free, irrevocable, non-exclusive right and license to distribute such content or incorporate such content into any form, medium, or technology now known or later developed throughout the universe.

• EXCEPTION: Data uploaded that is protected by HIPPA or FERPA or that should be considered confidential due to private contact information.

Third Party Content and Advertisers

Third party content may appear on or be accessible through FireDataOnline. FireDataOnline shall not be responsible for and assumes no liability for any third party content. FireDataOnline may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on FireDataOnline is accurate and complies with applicable laws. FireDataOnline will not be responsible for the illegality of any error or inaccuracy in advertisers' or sponsors' materials.

Accuracy Of Information

You agree to provide FireDataOnline with accurate and complete information when information is requested. It is your responsibility to inform FireDataOnline of any changes to that information.

Errors and Corrections

FireDataOnline does not represent or warrant that FireDataOnline will be error-free, free of viruses or other harmful components, or that defects will be corrected. FireDataOnline does not warrant or represent that the information available on or through FireDataOnline will be correct, accurate, timely, or otherwise reliable. FireDataOnline may make improvements and/or changes to FireDataOnline at any time without notice.

DISCLAIMER

FIREDATAONLINE IS PROVIDED ON AN "AS IS" BASIS. FIREDATAONLINE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. FIREDATAONLINE DISCLAIMS ALL RESPONSIBILITY FOR ANY LOSS, INJURY, CLAIM, LIABILITY, OR DAMAGE OF ANY KIND RESULTING FROM, ARISING OUT OF OR ANY WAY RELATED TO ERRORS OR OMISSIONS INCLUDING TECHNICAL INACCURACIES, ANY THIRD PARTY CONTENT, THE UNAVAILABILITY OF FIREDATAONLINE, OR YOUR USE OF FIREDATAONLINE.

LIMITATION OF LIABILITY

FIREDATAONLINE SHALL NOT BE LIABLE FOR ANY LOSS, INJURY, CLAIM, LIABILITY, OR DAMAGE OF ANY KIND RESULTING FROM YOUR USE OF FIREDATAONLINE. FIREDATAONLINE SHALL NOT BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, ATTORNEYS' FEES) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THE USE OF OR INABILITY TO USE FIREDATAONLINE. TO THE EXTENT THIS LIMITATION ON LIABILITY IS PROHIBITED, FIREDATAONLINE SOLE OBLIGATION TO YOU FOR DAMAGES SHALL BE LIMITED TO A REFUND OF THE PRICE FOR USER'S CURRENT SERVICE CONTRACT (BUT IN NO EVENT MORE THAN THE PRICE OF A FULL ONE YEAR SERVICE CONTRACT).

Indemnification

You are solely liable for any content or information you upload to FireDataOnline. You agree to indemnify and hold harmless FireDataOnline from any third party claim, action, demand, loss, or damages (including attorney's fees and costs) arising out of or relating to your violation of these terms and conditions of use, your use of FireDataOnline, or your violation of any rights of a third party.

Governing Law

These terms and conditions of use are governed by and construed in accordance with the laws of the State of Missouri. Any action arising out of or relating to these terms shall be filed only in state or federal courts located in Missouri and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action .

Severability

These terms and conditions of use incorporate by reference any notices contained on FireDataOnline and constitute the entire agreement with respect to access to and use of FireDataOnline. If any provision of these terms and conditions of use is unlawful, void, or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.

Modification

FireDataOnline reserves the right to change these terms and conditions of use at any time. Updated versions of the terms and conditions of use will appear on FireDataOnline and are effective immediately. You are responsible for regularly reviewing the terms and conditions of use. Continued use of FireDataOnline after any such changes constitutes your consent to such changes.
